Le Parlement européen se réunit fin mars pour le vote final de la directive droit d'auteur. Un texte âprement discuté depuis bientôt trois ans qui doit enfin permettre aux médias et aux artistes de percevoir une part des revenus générés sur Internet par leurs productions.
Jusqu'à présent, ce sont les géants américains du Web qui captent l'essentiel des profits. L'enjeu est majeur pour la presse, les artistes, la démocratie et la culture. Et l'objet d'une incroyable bataille menée par les grandes plateformes.
Depuis des mois, la menace est relayée sur tous les réseaux sociaux: si la directive européenne sur le droit d'auteur était adoptée, c'en serait fini de la liberté de l'Internet. Les internautes n'auraient plus accès à la gratuité des services. La création, l'information seraient étouffées pour laisser place à la censure. Nous perdrions ce qui a pris une place centrale dans nos vies: un Internet libre et d'une richesse illimitée. Perspective terrifiante… Relayée par des dizaines de milliers de sites, une pétition au titre comminatoire «Sauvez Internet» circule. Qui ne se battrait pas pour une telle cause?
Et pourtant, force est de constater que toutes ces affirmations péremptoires relèvent de l'une des plus intenses campagnes de désinformation jamais organisées.
Les deux plus grandes plateformes américaines siphonnent aujourd'hui près de 80 % des revenus publicitaires sur Internet. Payer quelques centaines de millions aux producteurs de contenus ne signera pas leur arrêt de mort, pas plus que d'acquitter un minimum d'impôts en Europe
Les internautes devront-ils désormais payer pour accéder à Internet et échanger des fichiers? Non. La directive le dit clairement. Seules les plateformes qui engrangent des revenus conséquents devront rémunérer médias, artistes et auteurs.
Vont-elles être ruinées au point de ne plus pouvoir opérer? Loin de là: grâce à leur position ultradominante, les deux plus grandes plateformes américaines siphonnent aujourd'hui près de 80 % des revenus publicitaires sur Internet. Des dizaines de milliards de dollars par an. Payer quelques centaines de millions aux producteurs de contenus ne signera pas leur arrêt de mort, pas plus que d'acquitter un minimum d'impôts en Europe.
C'est d'ailleurs ce que font toutes les autres entreprises qui distribuent des contenus: elles paient ceux qui les produisent.
Autre «fake news» colportée par les lobbys, la directive engendrerait la censure. Un comble quand on sait que des journalistes ont payé de leur vie leur combat contre la censure. Si des articles ou des chansons disparaissent du Web, ce sera le seul choix des grandes plateformes. Aujourd'hui, elles menacent clairement les médias et les artistes de le faire. Et ce pour une seule et unique raison: elles ne veulent pas les rémunérer.
La menace n'est pas théorique. Par le passé, un grand moteur de recherche a brièvement «déréférencé» les médias d'un pays européen qui réclamaient leur dû. Ils ont dû capituler pour continuer à exister sur Internet. Plus récemment, Wikipédia Italie a fermé, à la veille d'un vote du Parlement européen sur la directive, en septembre dernier, pour «montrer» aux internautes à quoi ressemblerait le monde né de la directive. Intimidation étrange: Wikipédia n'est pas concerné par le texte de l'Union européenne.

C'est précisément pour éviter de tels scénarios que les États de l'Union européenne s'unissent. Il va être plus compliqué pour les géants du Net de déréférencer les médias de quelque 500 millions d'Européens. L'Union européenne est un marché dont ils ne peuvent pas se passer.

Oui, l'internaute a besoin d'une presse pluraliste et libre. Oui, il a besoin d'être protégé contre les «fake news», les tentatives d'instrumentalisation de l'opinion, la propagande des États, des lobbys économiques et des trolls. Oui, enfin, il a besoin d'une démocratie vivante. Mais pour cela, il faut des médias indépendants et critiques qui puissent vivre de leur travail. L'adoption de cette directive droit d'auteur est une question de vie ou de mort pour les médias, et de survie pour beaucoup d'artistes et d'auteurs.
C'est aussi une question de survie pour un Internet riche et diversifié, où l'information et la culture ont toute leur place.
